These Terms of Service (“Agreement”) govern the use of yacht charter services provided by JPM Nautical (“we,” “us,” or “our”). By booking a charter, you agree to be bound by these Terms.

Arranging Yacht Charters

You will be responsible for arranging charters with a Yacht Charter Specialist, through the JPM Nautical website, application, or other method acceptable to JPM Nautical. Acceptable methods may include email, text message, or telephone with a Yacht Charter Specialist.

Confirmation of Charters

JPM Nautical will confirm the availability of the yacht, coordinate the signature of all necessary documents for reserving the yacht, and receive payment. It is your sole responsibility to carefully verify all travel details reflected in the confirmation when booking. Upon your acceptance of the confirmation, you become subject to JPM Nautical’s cancellation policy.

Payment for Charter Services

You agree to open an account with JPM Nautical and provide all requested information, including a credit card to be kept on file for pre-authorization/reserve and payment/capture for services according to these terms and conditions, as well as others which may be included at the time of booking.

When reserving a yacht, payment will be processed for the Total Price stated on the website and/or application as follows:

  • If a reservation is confirmed more than 7 days prior to the charter date, JPM Nautical will charge you a non-refundable reservation deposit equal to the greater of $1,000 or 50% of the Total Price (the “Reservation Deposit”).

  • On the 7th day prior to the charter date, you will be charged the remaining balance of the Total Price.

  • If a reservation is confirmed 7 days or less prior to the charter date, the Total Price will be charged in full.

JPM Nautical, at its sole discretion, may make promotional offers with different features or rates to any of our customers. These offers, unless made to you directly, will have no bearing on your booking. JPM Nautical may change the fees for our services or application as necessary.

Additional Expenses

Additional expenses may be incurred for the following: pet fees, cleaning due to pets or extraordinary mess, special catering orders, ground transportation, fuel surcharges (for high-speed travel), and foreign water entry fees. These charges may originate from JPM Nautical as the broker or from a third-party provider.

Unless otherwise noted, such charges will be billed to the credit card on file. If additional expenses are accrued, JPM Nautical will charge the card and provide a final invoice detailing incurred charges.

Late payments (more than 5 days overdue) will incur interest at 1.5% per month or the maximum allowed by law. Rejected payment methods that result in fees (e.g., insufficient funds) will be reimbursed by you to JPM Nautical.

Identification and Travel Documentation

In compliance with United States Coast Guard (“USCG”) and other governmental regulations, all guests must present valid identification prior to departure. For international charters, a valid passport and any required visas or entry documentation are required. JPM Nautical reserves the right to refuse boarding for failure to provide required documentation, without recourse.

Passenger information must be provided accurately at the time of booking or no later than 24 hours prior to departure. Failure to provide accurate and timely information may result in boarding denial, cancellation without notice, and applicable cancellation penalties.

Missed Charters

You must be at the yacht, prepared to travel, at the departure time listed in your Yacht Charter Itinerary. If you arrive more than 30 minutes after the scheduled departure time, you will be considered to have missed the charter.

Captains may wait up to 1 hour as a courtesy but are under no obligation to do so. If you miss a charter, you are responsible for alternate arrangements, and JPM Nautical will make best efforts to assist, at an additional cost.

Disclaimer of Responsibility for Delay/Cancellation

JPM Nautical is not liable for delays or cancellations caused by events beyond our control, including but not limited to: acts of God, civil unrest, strikes, government regulations, adverse weather, fuel shortages, mechanical issues, illness of crew, or denial of permits. In such cases, JPM Nautical will make best efforts to arrange alternatives, but liability will not exceed the amount paid to JPM Nautical.

Cancellation Policy

Day Charters

  • Cancellations made 14 days or more prior to the scheduled charter date are eligible for a full refund.

  • Cancellations made within 14 days of the scheduled charter date are non-refundable. However, in such cases, the client will be offered either:

    • A credit equal to the value of the original booking, to be applied toward a future charter, or

    • The opportunity to reschedule the charter to another available date, subject to availability.

Term Charters

  • All cancellations for term charters are governed by the MYBA Charter Agreement - Clause 9 (Cancellation by the Charterer).

  • In summary, the client may cancel the charter at any time prior to embarkation by giving written notice to the Owner via the Broker. However, the following cancellation terms will apply:

    • If cancellation occurs more than 120 days prior to embarkation: the Charterer forfeits the initial deposit.

    • If cancellation occurs between 120 and 30 days prior to embarkation: the Charterer forfeits 50% of the total charter fee.

    • If cancellation occurs less than 30 days prior to embarkation: the Charterer forfeits 100% of the total charter fee.

  • If the yacht is re-let for the same period and at the same rate, any forfeited funds may be refunded (less any administrative costs), in accordance with the MYBA terms.


Yacht Condition

You agree to reimburse JPM Nautical for reasonable costs of any damage to the yacht or its equipment caused by you or your guests.

Insurance

It is the sole responsibility of the yacht owner to maintain liability insurance coverage, including proper charter insurance. JPM Nautical is not liable for any claims arising in connection with or related to the yacht.
